Medical Vs. Recreational
Often dispensaries offer a discounted rate for medical cannabis items.
Here's a breakdown of the cannabis tax in NY:
Medical Cannabis
Excise Tax: A 3.15% excise tax is imposed on the gross receipts from the sale of medical cannabis by registered organizations (dispensaries).
Who Pays: This tax is paid by the registered organization, not the patient.
No Direct Charge to Patients: Dispensaries cannot add the excise tax as a separate charge or line item on the patient's receipt.
Sales Tax Exemption: The sale of medical cannabis to registered patients is exempt from sales tax.
Recreational cannabis
State Excise Tax: 9% of the retail price goes to the state.
Local Excise Tax: 4% of the retail price goes to the local municipality (city, town, village, or county) where the dispensary is located.
Who Pays: this 13% tax is paid by the buyer/patient it is added to the purchase price at the point of sale and is collected by the dispensary from the consumer then remitted to the state and local governments.
Savings with a medical card can add up to thousands annually.
